INEC’S SELECTIVE JUSTICE: OBEYING SUPREME COURT FOR GOVERNORSHIP BUT DISOBEYING FOR NATIONAL ASSEMBLY – EGBA INTEGRITY GROUP SLAMS INEC, CONSIDERING CONTEMPT ACTION

The Egba Integrity
Group (EIG) condemns in strongest terms the selective enforcement of the law by the Independent National Electoral Commission (INEC) following its Commission meeting of Thursday October 29, 2026.

We must protect Supreme Court decisions and ensure INEC obeys all laws of the land, not some.

THE FACTS:

The Supreme Court on *September 24, 2026 in INEC v ZLP SC/CV/495/2026* held that *Section 77(5)(6)(7) Electoral Act 2026 is MANDATORY.*

No political party that fails to submit its authentic membership register to INEC between *April 21 – May 10, 2026* can validly sponsor ANY candidate – whether Governorship, Senate, House of Representatives or State Assembly.

WHAT INEC DID ON OCT 29 – SELECTIVE ENFORCEMENT:

For Governorship: INEC enforced strictly.
Isa Pantami (PDP Gombe) – Cleared conditionally
Abdulsalam Gwarzo (NDC Kano) – Cleared conditionally
Ladi Adebutu (PDP Ogun Gov) – REJECTED. INEC Quote: “The Ogun PDP candidate did not succeed.”*

For National Assembly: INEC refused to enforce Same PDP Ogun defective register that disqualified Adebutu was used to retain Sen. Iyabo Obasanjo (PDP Ogun Central)* and other National Assembly candidates.

That is illegal discrimination.

Section 77 does NOT distinguish between Governor and Senate. The register is ONE. If register is invalid for Governor, it is invalid for Senate.

OUR GROUNDS:

1. Violation of Section 42, 1999 Constitution – Discrimination & Equality
INEC cannot apply Supreme Court judgment to Governors and ignore same for Senate and House of Representatives. Same law, same register, same party.

2. Ultra Vires – Acting Beyond Powers*
Under Section 77, INEC has no discretion. Supreme Court said it is mandatory. Picking and choosing makes the National Assembly list published Oct 10 liable to be voided.

3. Breach of Legitimate Expectation & Abuse of Office
How can PDP Ogun register be bad for Adebutu but good for Iyabo? Egba people reject selective justice.

*OUR DEMAND:*

We hereby give INEC *7 DAYS* from today to:

1. Apply SC/CV/495/2026 equally to National Assembly list published Oct 10, 2026
2. Withdraw names of all candidates including *Iyabo Obasanjo* who are not in PDP authentic register

Failure to do so, Egba Integrity Group shall ensure:

a) *Contempt / Mandamus* proceedings at Federal High Court Abeokuta in *Suit No. FHC/AB/CS/117/2026 – Sogbesan Amoo vs INEC & Ors*

b) File *Declaration* that INEC National Assembly list of Oct 10 is invalid to extent it includes candidates not in register.
